Ki-Ki Designs reserves the right to refuse services, terminate accounts, or cancel orders at any time in its sole discretion, including, and without reservation, based on the conduct of a subscriber who violates the term applicable by law.

Ki-Ki Designs has the right to change or discontinue the Service (or any part thereof), temporarily or permanently, with or without notice. You agree that Ki-Ki Designs cannot be held liable against you or any third party for any changes, cessation or suspension of the Service.

General

Ki-Ki Designs reserves the right, for the purposes of preventing alleged fraud and with notice to you, to refuse to accept and/or process payment for an order, and/or to cancel any sales transaction in whole or in part.
Ki-Ki Designs is only liable for the refund of fees already paid by the user and accepts no other liability that may arise from such refusal to process any order/sale.

Ki-Ki Designs reserves the right to change and modify the prices and rates quoted on this website without any notice.

Ki-Ki Designs strives to accurately describe and/or portray every product on the website. Ki-Ki Designs will do anything that is reasonably within its ability to accurately indicate prices and delivery costs. However, if products are incorrectly offered at the wrong prices and/or delivery costs, Ki-Ki Designs will not be obliged to sell the products at such incorrect prices and/or delivery costs, but will refund any fees paid by you to you if you prefer not to proceed with the purchase transaction at the correct price and/or delivery cost.

Refund Policy

If any product you receive is defective, damaged or inappropriate for the purpose for which it is intended, you are entitled to return the product (at Ki-Ki Designs’ expense) for a full refund or for replacement, provided that the faulty product is returned to Ki-Ki Designs within one month of delivery.
Please note in this regard that:
• a “defect” is not something that results from normal wear and tear;
• “Damaged” means that the product must be damaged when you receive it and that it was not damaged by you or anyone else who received it;
• an item is not “inappropriate” based on the nature of the content or because you enjoyed or did not enjoy the item; and
• Ki-Ki Designs will examine the returned product to determine if the alleged problem is indeed justified or not. If the problem is not justified, you will be liable for the cost of return to Ki-Ki Designs, for inspection and re-delivery to you. We therefore encourage you to report any problems you discover promptly after you discover them.

Ki-Ki Designs offers the following payment methods:
Electronic Fund Transfer or Cash on Collection

Delivery

For deliveries we use Aramex and Courier Guy. We reserve the right to use any other service provider if necessary. Make sure you provide a valid delivery address and contact number. Contact us if your package is not received within the estimated delivery time. We are happy to help track the package.

Should a parcel return undelivered, we will notify you and request you to make alternative arrangements for the re-delivery to you. You agree and give us power of attorney to dispose of the package, donate it, or resell it if it is not claimed within six months.
Deliveries in the areas outside the service provider’s area will be charged at a higher rate, and are in addition to the price of the product purchased.

Events Out of Our Control

We will not be liable or responsible for any failure or delay in the performance of any of our obligations in terms of the Contract, when caused by events beyond our reasonable control (Force Majeure).
A Force Majeure includes any act, event, non-event, omission or accident beyond our control, and specifically (without limitation) includes the following:
• Strikes, exclusions or any other industrial action;
• Civil uprising, riots, invasions, terrorist attacks or threats thereof, wars (declared or not) or threats or preparations for wars;
• Fires, explosions, storms, floods, earthquakes, recessions, epidemics or other natural disasters;
• Cases where the railways, ships, aircraft, cars or any other forms of public or private means of transport are not usable;
• Case where public or private telecommunications networks are not usable; and
• The acts, orders, laws, regulations or restrictions of any government.
Our actions under this Contract will be suspended for the period of Force Majeure, and we will have a longer period for action during this time. We will make a reasonable effort to stop the Force Majeure, or try to find a solution so that our obligations under the Contract can be met despite the Force Majeure.

Pardon

If we fail to, at any time during the Contract, insist that you comply with your requirements under the Contract or any of these Terms and Conditions, or if we do not comply with any of the rights or remedies to which we are subject under this Contract is not entitled, it will not be construed as a waiver of such rights or remedies and will not absolve you from your compliance with such obligations.
A waiver by us of any default does not count as the waiver of a subsequent default.

No waiver by us of any of these Terms and Conditions will be effective unless clearly set out as a waiver and communicated to you in writing.

Our Right to Modify These Terms and Conditions

We have the right to review and adjust these Terms and Conditions from time to time to reflect the following: changes in market conditions affecting our business, changes in technology, changes in payment methods, changes in relevant laws and regulatory requirements and changes in the capabilities of our systems.

You will be subject to the policies, Terms and Conditions that are valid when you order your product from us, unless a change in these Policies, Terms and Conditions is required by law or made by government authority (in which case it will apply to orders you have previously placed), or if we notify you of the change in the Policies, Terms and Conditions before we send you the Confirmation of Shipping (in which case we have the right to accept that you have accepted the change in Terms and Conditions, unless you notify us of the opposite within seven working days of receiving the products).

Legislation and Jurisdiction

Contracts for the purpose of purchasing products from Ki-Ki Designs and any dispute or claim arising out of or in connection with these contracts, or from their subject matter or formation (including non-contractual disputes or claims) will be governed by South African law.

User-Generated Content

The reviews, comments and other user-generated content are provided for your use. However, any views and opinions expressed by users of our website are not necessarily those of Ki-Ki Designs.
User-generated content fields should not comply with the following:

• be in violation of any relevant local, national or international law, or encourage or incite the violation of such law;
• racist, sexist or homophobic;
• pornographic, immoral, blasphemous or vulgar;
• defamatory of any person, entity or organization;
• not defamatory, threatening, offensive or otherwise harmful
• infringes the rights (including intellectual property rights) of any person;

If you violate these terms and conditions, we reserve the right to suspend or delete your account.

Ki-Ki Designs reserves the right to transfer or edit any user-generated content from the website without prior notice to the author of this content. Ki-Ki Designs does not accept responsibility or liability for any user-generated content and therefore, by publishing the content, the author accepts that the content is in the public domain.
